INTRODUCTION OWNERSHIP OF THE WEBSITE
These conditions of use and purchase (hereafter the “General Conditions”) regulate the terms and conditions of contracting of goods offered on the Website https://dehesaelmolinillo.com (hereafter the “Website”), owned by NORTIA AGRICULTURAL, S.A. (hereafter “DEHESA EL MOLINILLO” or the “Company”), with registered office at Carretera CM-4017, km 50 – Finca el Molinillo, 13194 Retuerta del Bullaque (Ciudad Real), holders of tax code A-28196855 and inscribed in the Companies Register of Ciudad Real in volume 671, folio 71, page CR-31107, entry 1.
AIM AND SCOPE OF THE GENERAL CONDITIONS
These general conditions (hereafter the “General Conditions”) define the terms under which DEHESA EL MOLINILLO provides you with the means necessary to contract the goods offered on the Website, and makes available the precontractual information regarding the possible transactions that may be conducted thereon.
These General Conditions are complementary to the “Legal Notice and Conditions of Use”, the “Privacy Policy” and the “Cookies Policy” applicable to the Website, as well as the “Particular Conditions” of contracting that, if relevant, are applicable for each of the goods and services made available to you.
These General Conditions shall always be available to the Users on the Website in Spanish so that the User may consult them, file them or print them at any time.
ACCESS TO THE WEBSITE AND REGISTRATION
To the effects of these General Conditions, user shall be understood to be any person who browses the Website (hereafter the “User”). Similarly, customer or consumer shall be understood to be any User who purchases any product offered on the DEHESA EL MOLINILLO Website and who accepts these General Conditions (hereafter and without distinction the “Customer” or “Consumer”).
DEHESA EL MOLINILLO provides the products mentioned above exclusively for peninsular Spain, excluding the Balearic Islands, Canary Islands, Ceuta and Melilla (hereafter the “Territory”).
Upon accessing the Website, the User shall declare that they are of legal age and have the necessary legal capacity to contract the products offered on the Website in accordance with these General Conditions, which they likewise declare they understand and accept in full.
PURCHASE PROCESS
Shopping in our online shop is very straightforward. DEHESA EL MOLINILLO informs the Users that they may buy any product through the Website without the need to register.
To buy any of the products, Users must access our online shop and select the products they want. Once they have selected all the products they would like to buy, Users must then enter the data requested to be able to process their order: contact details, shipping address and billing information.
Once the purchase order has been completed, and before the order is sent, a summary will be shown identifying the item purchased, its total price (including shipping and taxes) and the delivery information. The order must be confirmed after entering the necessary information to make the corresponding payment, by clicking on the button “Pay”.
To validate the purchase order, you must be familiar with and expressly accept these General Conditions as part of entering into the contract formalised in Spanish. DEHESA EL MOLINILLO shall store the data that constitutes evidence that the contract has been entered into, which shall be accessible at all times.
Similarly, once you have made the purchase, DEHESA EL MOLINILLO will send you an email with the purchase confirmation and receipt, to the address you have indicated for this purpose, as soon as possible and always within 24 hours of making the purchase. If you do not agree with the data set out in the receipt, you may request its modification or the cancellation of the contract, provided the preparation and shipping of the order has not yet begun.
When you fill in the data requested in the purchase process on the Website, the required fields are duly highlighted in red so the User can identify them clearly. Similarly, the data that is detected by the Website to have not been correctly entered, or be improper or incomplete and is required to complete the process in question will be requested again so the User may check it, correct it and enter it correctly.
As the User, you are solely responsible for providing you data correctly in the online purchase process on the Website. In the event that you make the online purchase using your User account, you shall be solely responsible for maintaining the confidential, personal and secret nature of the corresponding passwords and registration login details. Therefore, DEHESA EL MOLINILLO reminds you that you must pay special attention and take care when entering your personal data, especially your bank details and order delivery address and not share your registration login name and password corresponding to your User account with third parties. You will be solely responsible for any resulting direct or indirect harm to DEHESA EL MOLINILLO or third parties under your email or registration login name and/or password.
DEHESA EL MOLINILLO reserves the authority to check, retain, temporarily suspend and/or definitively cancel unilaterally, without prior warning and without the right to damages of any kind any purchase from the online shop in which it detects indications of use that is fraudulent, unlawful or contrary to these General Conditions, the law and/or good faith by the corresponding User.
SALES AND PROMOTIONS
To generate loyalty among Users, gain new Users or promote certain products, DEHESA EL MOLINILLO may organise different promotions through the Website. Similarly, it may establish sales periods or apply discounts to all or some of the products available from the online shop on the Website.
In each case, DEHESA EL MOLINILLO will regulate the conditions of application and benefit of the different promotions.
PRODUCT AVAILABILITY
All the offers on products available on the Website will include the information about their essential characteristics, as well as the final prices expressed in euros with all applicable taxes, including VAT.
Without detriment to the above, DEHESA EL MOLINILLO reserves the right to decide regarding the products offered at any time on the Website, and may add new products, which shall be governed by these General Conditions. Similarly, it may remove any products from the Website, at any time and without prior notice.
DEHESA EL MOLINILLO strives to ensure that all the products offered on the Website are available to Users at all times. Nevertheless, it is possible that certain products may be temporarily unavailable or out of stock. In the event that any product is not available on the Website, DEHESA EL MOLINILLO will duly indicate this so the Users are informed that it is temporarily not possible to acquire the product in question.
If for any reason any product is not available once the online purchase is completed by a User, DEHESA EL MOLINILLO will contact the User as soon as possible by email or telephone to inform them of the situation and the User will be able to choose whether to cancel their purchase or select a different product.
PRICES
The price set out for each product on the Website includes VAT. VAT shall be applied at the corresponding rate in accordance with the current legislation. If applicable, DEHESA EL MOLINILLO will always specify the corresponding taxes and the shipping costs before the User makes any payment.
DEHESA EL MOLINILLO reserves the right to change the prices of the products offered on the Website at any time and without prior warning, although this modification shall not affect orders already placed by the User and for which DEHESA EL MOLINILLO has already sent the User the corresponding “Order Confirmation”.
The Company shall not be obligated to supply any product at an incorrect lower price (even after the “Order Confirmation”), if the pricing error is obvious and unequivocal and could reasonably have been recognised by the User and/or the Company.
The Company offers its Users the option of selecting the shipping address upon initiating the purchase and seeing the prices of the products in conjunction with the corresponding taxes and special shipping costs included. If the User later modifies the delivery address and the destination is changed, the prices shown in the final order summary may vary.
Because the postage costs can vary between geographical zones, the prices of the products offered on the Website do not include the costs that may be incurred depending on the shipping destination. In any event the User can check the delivery cost and conditions according to the shipping destination when they select the products included in their shopping basket. They are calculated when the shipping address is entered, before any payment is made by the User.
Should the tax rate be modified between the reservation date and the delivery date of the services, in accordance with tax regulations, the tax rate that shall be applied to the final price shall be that corresponding to the time of delivery of the services.
PAYMENT METHOD
Users must pay for their purchases from the online shop by credit or debit card (Visa, MasterCard and American Express). The User should simply complete the purchase process form up to the payment method, which is where they have to enter the data required.
Transactions made on the Website are 100% secure. To make the payment, DEHESA EL MOLINILLO uses a secure server with an encrypted password. All information related to your credit card is encrypted when transmitted over the network and is sent directly to the bank. Your credit or debit card data is not recorded in any database.
In the event the credit card is not valid, DEHESA EL MOLINILLO may cancel the order or request that the User update their information or payment method.
SHIPPING AND DELIVERY OF ORDERS
Shipping
DEHESA EL MOLINILLO reminds Users that it offers the products available through the Website for delivery throughout the whole peninsular region.
In the tab “Shipping address” in the purchase process, Users can select the address where they want DEHESA EL MOLINILLO to send the shipment. To optimise the delivery process, the shipping address indicated in each case by the User must be an address at which the delivery can be effectively made, so DEHESA EL MOLINILLO recommends that Users evaluate the address they communicate as the shipping address carefully and always check the delivery information is correct and complete. If the billing address is the same as the shipping address, the User may specify this in the section “Billing address” by selecting the checkbox “The same as the shipping address”.
DEHESA EL MOLINILLO will deliver the products acquired from the online shop to the Users at the address indicated by the Users in the order form, within the timelines specified at all times on the Website and in any event, within a maximum of [5 *] business days from date of reception of the “Order confirmation” sent by DEHESA EL MOLINILLO for all orders made in Spain.
DEHESA EL MOLINILLO does not guarantee to fulfil the abovementioned delivery times in the event of force majeure, third-party actions or omissions or in the case the delivery address indicated by the User in the purchase process is incomplete, inexact or incorrect.
The products acquired on the Website are shipped to Users through collaborating companies or courier or transport service providers contracted by DEHESA EL MOLINILLO.
The delivery is considered complete from the moment the products have been made available to the User or a third party they have indicated or that states they are duly authorised by the User to receive them at the shipping address indicated by the latter.
If the User is absent when the shipment is delivered at the address they have indicated, the carrier will leave a notification indicating how to proceed to arrange a new delivery. If, after fifteen (15) calendar days from the notification date, the User has not contacted the carrier to arrange a new delivery date, the order shall be returned to DEHESA EL MOLINILLO and the User must cover any shipping and return costs that may be applicable.
Shipping costs
The shipping costs may vary depending on the purchase amount and of the order shipping region selected by the User:
- If the purchase amount is under seventy-five euros (€75.-) euros the shipping cost is 7 euros.
- If the purchase amount is over seventy-five euros (€75.-) euros shipping is free of charge.
RETURN OF DAMAGED OR DEFECTIVE PRODUCTS
The risks of loss or damage to the products acquired by the User from the DEHESA EL MOLINILLO online shop will lie with the User once the courier or transport service contracted by DEHESA EL MOLINILLO for shipping delivers them to the User or to a third party authorised by the User.
The products are always transported at the risk of the collaborating companies or courier or transport service providers contracted in each case by DEHESA EL MOLINILLO. For this reason, DEHESA EL MOLINILLO strongly recommends you to check that the exterior of the package containing the products you have acquired is not damaged and that the contents have not been damaged when your order is delivered. If upon examining the shipment and/or its contents the User notices that it is damaged or broken, they may return it to DEHESA EL MOLINILLO free of charge.
To formalise the return, the User must contact DEHESA EL MOLINILLO at the email address info@dehesaelmolinillo.com indicating the product or products to be returned, attaching a photograph and a detailed list of the defects observed therein. Upon receiving this communication, DEHESA EL MOLINILLO will indicate how the defective product must be shipped or collected, at no cost to the User.
Each defective or damaged product to be returned must have the seal intact and all of its labels, packaging and, if applicable, documentation and original accessories that came with it. Once the effective existence of damage or defect in any of the products selected has been verified, DEHESA EL MOLINILLO shall process its replacement with the corresponding manufacturer or distributor for another of identical characteristics. If it is not possible to replace the product, DEHESA EL MOLINILLO will inform the User of this situation and refund the proportional amount corresponding to the product from the total amount paid. In this case, the refund of the amount paid by for the purchase of the product returned shall be made as soon as possible and, in any event, within the following thirty (30) days.
USER’S RIGHT OF WITHDRAWAL
The right of withdrawal is the power the User has as a consumer to withdraw from the contract entered into with DEHESA EL MOLINILLO upon purchasing a product from our online shop, without the need for any justification, or application of any penalty except the costs expressly stipulated in these General Conditions.
The User may cancel purchases made from the online shop of DEHESA EL MOLINILLO within a maximum of 14 calendar days from the day the User or a third party indicated thereby, other than the carrier contracted by DEHESA EL MOLINILLO, takes material possession of the goods ordered, provided the seals on the products have not been broken. Thus, DEHESA EL MOLINILLO informs you that if you purchase any sealed product from the Website, once the seal has been broken, you may not exercise your right of withdrawal on this product.
To exercise the right of withdrawal the User simply has to communicate this to DEHESA EL MOLINILLO within the aforementioned period of 14 calendar days at the email address info@dehesaelmolinillo.com.
The email must indicate your data (full name, address, email, contact phone number), the order number, the order date and the items you wish to return.
Once they have reported their wish to cancel the purchase of products from our online shop, the User must send the products covered by this withdrawal to the address Carretera CM-4017, km 50 – Finca el Molinillo, 13194 Retuerta del Bullaque (Ciudad Real) without delay and, in any event, within a maximum of 14 calendar days from the date on which the decision to cancel the contract with DEHESA EL MOLINILLO was communicated.
DEHESA EL MOLINILLO informs the User that, in the event of withdrawal, the User must cover the costs of returning the products covered by this withdrawal as DEHESA EL MOLINILLO shall not accept them or collect the products.
To carry out the return, the products covered by this withdrawal must be unused and with the seal intact and must be returned with all their labels, packaging and, if applicable, documentation and original accessories that came with them. After inspecting the product, DEHESA EL MOLINILLO shall refund the User all payments received from them within a maximum of 14 calendar days from the date of reception of the returned product, and reserves the right to reduce this refund amount should the value of the products be reduced due to their handling.
DEHESA EL MOLINILLO shall refund the corresponding amount with the same payment method that the User used to make the purchase through the Website. DEHESA EL MOLINILLO reserves the right to withhold the refund to the User until (i) it has received the products subject to the withdrawal; and (ii) it has inspected and verified that the product is complete, unused, and the seal remains intact. In any case, this period shall not exceed 14 days from the reception of the products.
DEHESA EL MOLINILLO informs that if, when purchasing the products, the User expressly selects a delivery method other than the cheapest ordinary delivery method, DEHESA EL MOLINILLO shall not be obligated to refund the additional costs arising therefrom.
LEGAL GUARANTEE
The products that DEHESA EL MOLINILLO offers are covered by a legal guarantee corresponding to each product. Thus, in the event of a non-conforming product, a period of 1 year is acknowledged for consumers counted from the moment of delivery in which the User may exercise their rights.
In the event that the User requires the correction of a product that does not conform to the agreed purchase conditions, the User will have the option of requesting a replacement of the product in question, except when this is impossible or disproportionate. If a replacement is not possible or is disproportionate, DEHESA EL MOLINILLO shall inform the User so they may choose to request a price reduction or the termination of the contract.
After the first six months from the invoice date, the replacement products will be sent and the delivery costs paid by the User. DEHESA EL MOLINILLO reserves the right to verify that the fault was caused by manufacturing or production defect. If the product is under guarantee, DEHESA EL MOLINILLO shall pay the Customer the delivery costs paid and the return to the User will be paid by the Company. If the product is not under guarantee, the User will have to collect the product and pay the shipping costs.
To make use of the guarantee the User must communicate this previously to DEHESA EL MOLINILLO through any of the Customer Care methods that the company makes available, and shall not accept in their offices any product that has not previously been authorised for exchange or return.
The guarantee only covers the holder (contractual party) stated on the invoice and may only be requested by the holder themselves.
CUSTOMER SERVICE
Similarly, DEHESA EL MOLINILLO provides the Users with a Customer Service Department through the CONTACT form, through the email info@dehesaelmolinillo.com, or on 925 590660 (Workdays Monday to Friday from 9 am to 3 pm and in August Workdays Monday to Friday from 9 am to 2 pm).

SECURITY
DEHESA EL MOLINILLO informs the Users that it may be construed as electronic fraud to use the electronic payment system included on the Website to purchase products offered on it in any of the following cases:
a) Providing false data of the purchaser or card number used as the payment method.
b) Using data from people other than the purchaser.
c) Misappropriating the condition of holder of other people’s bank accounts or cards.
d) Using card numbers generated by software or similar algorithms.
Similarly, DEHESA EL MOLINILLO informs Users that the Website incorporates the suitable safeguards and uses the standard technology of the sector to improve the security, integrity, exhaustiveness, accuracy and protection of your personal data, which it has gathered, and has established reasonable precautions to protect that information from possible losses or misuse. Its data protection and security regulations are reviewed periodically and improved when necessary, and efforts are made to ensure that only authorised persons can access information provided by Users.
DATA PROTECTION
As established in our Privacy Policy, DEHESA EL MOLINILLO shall process the Users’ data, with full confidentiality at all times, and use it in accordance with the purposes for which it was gathered, and fulfil its obligation to store it and apply all measures necessary to avoid the alteration, loss or unauthorised third-party processing or access in compliance with the current legislation on personal data protection.

DURATION AND MODIFICATION
These General Conditions shall be valid for the time they are available to Users on the Website. Therefore, when they are fully or partially modified or updated, these conditions will no longer be valid, and the new General Conditions shall regulate the use of the Website and the relationship between DEHESA EL MOLINILLO and the Users.
DEHESA EL MOLINILLO may, at any time and without prior warning, modify the Website and, in general, any function to make the changes it deems advisable to ensure its satisfactory operation. In addition, DEHESA EL MOLINILLO likewise reserves the right to modify these General Conditions, and the General Conditions valid at the time of entering into the contract shall be applicable. Nevertheless, these amendments shall take effect as of their publication on the Website, therefore the update and modification of these General Conditions shall always be accessible prior to contracting so you can familiarise yourself with them beforehand and accept the updated version, if applicable.
JURISDICTION AND APPLICABLE LEGISLATION
All matters of litigation related to the use of this Website shall be subject to Spanish legislation, and the resolution of any matters that may arise or action that may be taken resulting from the provision of the services and/or content of the Website, as well as the interpretation, application, compliance and/or non-compliance with that established herein shall be the competence of the Courts and Tribunals of the city of Barcelona, except when by peremptory norm it is established otherwise.
Similarly, in compliance with the Regulation (EU) 524/2013 of the European Parliament and of the Board of 21 May 2013 on the resolution of online disputes on matters of consumption and that modifies the Regulation (EC) 2006/2004 and the Directive 2009/22/EC, we inform you of the existence of a European platform for the resolution of online disputes that facilitates the extrajudicial resolution of such disputes over contracts entered into online.
The platform is an interactive, multilingual website http://ec.europa.eu/odr, which provides a single, free of charge access point for the extrajudicial resolution of contractual disputes arising from contracts entered into online.
GENERAL CONSIDERATIONS
Under no circumstances may the failure to exercise rights by DEHESA EL MOLINILLO be understood as a renunciation thereof.
The headings contained in these conditions are merely orientative or informative, so they do not affect, classify or expand the interpretation thereof.
If any of the clauses contained in these General Conditions were to be declared fully or partially null, abusive or not applicable, by a judicial or administrative body, this declaration shall only affect that individual clause in question, which shall be considered excluded and the declaration of being null, abusive or not applicable shall not for any reason be extended to the other of conditions, which shall subsist.
